What is what is a UK Rep?
A UK Rep is a person or company that is appointed by a manufacturer to take care of specific responsibilities related to product compliance in the UK. Based on the particular product legislation, this may include preparing UK Declarations of Conformity for medical devices, and also providing the an initial point of contact to the MHRA (Medical Device Regulations Agency). A Responsible Person is often known as an Authorised Rep.

The UK representative must be a firm, or organisation, established in the EEA and Become a Rep From Home capable of representing the company’s obligations under GDPR. This is typically an independent law firm. However it could also be a private business or a consultant. The contact details of the representative need to be easily accessible to data subjects from the EEA, for example, by putting them in your privacy notices or publishing the information on your website. This allows EEA-based data users to reach out to the representative regarding their concerns about your business’s handling of their personal information.
You must appoint your representative in writing and you must state the terms of your relationship with them. This is similar to a service contract. What are the responsibilities that a UK Rep has?

The duties of a UK Rep are outlined in Article 27 GDPR. This requires all companies that are outside the EU or that offer products or services to or observe the conduct of individuals in the UK to appoint a rep to act as a point of contact for the ICO.
A UK rep is the same as an EU authorized representative (EUAR) however, it is only valid for shopwithmyrep the United Kingdom. EUARs are responsible for ensuring compliance and providing information to MHRA.
A UKRP has more responsibilities with regards to the UK’s new Medical Device Regulation. For instance a UKRP is accountable for registering devices with MHRA and acting as the liaison between the manufacturer and MHRA. A UKRP is also responsible for the organization’s compliance with MDR.
Similarly, a union rep, or steward is legally entitled to represent their members at work and perform other duties at work. They are typically elected by the members concerned and are voted on through a ballot or meeting. The appointment is typically announced to the employer by the union.
Tour operators hire holiday representatives to work at their resorts in the UK and overseas during summer months. Representatives are trained in the UK before they are sent to their resorts. They usually require the ability to work and travel abroad. Representatives are overseen by the company they work for and may be subject to performance appraisals. They may also be paid a commission for bookings they make. The exact amount is dependant on the tour operator, but it is usually an amount of the tour operator’s profit. It is important that representatives are transparent about this with their customers. This should be clearly mentioned in the job description.
How do I find the UK Rep?
UK Data Protection law obliges companies based outside of the UK and provide services or goods to, or monitor the behaviour of individuals in the UK, appoint a UK Representative. The representative is the primary contact for data subjects and the ICO (Information Commissioner’s Office). The appointment of your UK Representative must be in writing and set out the conditions of your relationship with them. The presence of a representative does not affect your personal obligations and responsibilities under the GDPR.
The requirement for a UK Representative is applicable to any non-EU manufacturer selling into the GB market, except Northern Ireland (which still requires an EU Authorised Representative). The function of the UK Rep can be taken by any company that can prove their ability to meet the requirements of the relevant legislation governing the product and serve as an efficient point of contact between the manufacturer and the national market surveillance authorities and Notified Bodies. In the case of medical devices, an authorized representative is a recognized Certification Company. For other products, it could be the distributor or sales rep jobs agent.
You should make the contact information of your chosen UK Representative accessible to data subjects (individuals) whose personal data you manage and make them easy to locate. This can be done by putting the information in your privacy notice or putting them on your website. You don’t need to inform the ICO formally of your chosen representative, but their contact details should be easily accessible to them.
